Article 1. General conditions of application
1.1. The general terms and conditions apply to the contract as well as to all offers, agreements and services of Casa-Unlimited, unless the parties expressly agree otherwise.
1.2. The general terms and conditions shall, as far as reasonably possible, be provided to the (primary) tenant before or at the time of the conclusion of the contract.
Article 2. Conclusion of the agreement
2.1 The contract is concluded when the renter accepts the offer of Casa-Unlimited. The moment of acceptance is the moment at which the tenant provides Casa-Unlimited with the necessary information for the booking in writing, in person or by telephone.
The tenant who enters into a contract on behalf of or for the benefit of others is jointly and severally liable to Casa-Unlimited for all obligations arising from the agreement.
2.2 Casa-Unlimited will send the booking confirmation by e-mail within 24 hours after the booking has been made.
2.3 The details of the booking confirmation will include the name and contact details of the and the number of people who will be staying in the booked accommodation.
2.4 If there are any inaccuracies in the confirmation, the tenant must notify Casa-Unlimited within two working days after receipt of the booking confirmation.
2.5 Casa-Unlimited is entitled, on behalf of the owner of the accommodation, to refuse a booking on the following grounds on the basis of the (young) age and the size of a group of tenants.
2.6 Persons under 24 years of age, where the occupants of the accommodation to be rented are also under 24 years of age, are not permitted to make an online booking without the prior consent of the booking office. Failure to comply with this rule may result in the cancellation of the booking.
2.7 Right of withdrawal: Casa-Unlimited reminds you that once a booking has been made, it is legally definitive. There is no right of withdrawal.
Article 3. Payment by the tenant
3.1. The deposit is a percentage of the total rent (the percentage is indicated on the booking confirmation and the presentation of the accommodation(s) on the Casa-Unlimited website).
3.2 In order to allow the landlord to check the accommodation thoroughly, the deposit will be refunded no later than 8 days after the end of the rental period. In case of damage and/or loss of the rented property and/or in case of fault of the tenant, the total damage will be deducted from the deposit. If the damage and/or loss suffered to the rented property or to the owner and/or accommodation provider exceeds the deposit paid, the tenant is obliged to pay the balance directly to the accommodation provider. Breakage, loss and/or damage to the rented property must be reported immediately to the accommodation provider and the damage must be compensated
3.2 To make an reservation, 30% of the rental amount has to be paid
3.3. The balance of the rent must be received by Casa-Unlimited at least 56 days (8 weeks) before the dates as shown on the booking confirmation. In the event of late payment, the tenant is in default. In case of a booking within 56 days before arrival date, the full amount needs to be paid immediately. Casa-Unlimited must receive the full payment within 24 hours of the booking confirmation date. Casa-Unlimited will notify the tenant in writing by e-mail. The tenant can still pay the amount due within 48 hours. If payment is still not received by Casa-Unlimited, the contract will be deemed to have been cancelled on the date of default.
3.4 The rental price does not include insurances, unless it is expressly stated that the rental price includes insurances and the type of insurance is specified.
Article 4. Cancellation, modification or replacement by the renter.
4.1. Cancellations must be made by telephone and simultaneously confirmed by email to e-mail (info@casa-unlimited), quoting the booking reference number. Upon receipt of of the cancellation request, Casa-Unlimited will send a cancellation confirmation.
4.3 If cancellation is made 8 weeks before check-in, the guest will lose 50% of the prepayment for rent. With less than 8 weeks before check-in, the guest will lose 100% of the amount of the rent.
4.4 In case of no show, the guest will lose 100% of the amount of the rent.
4.5 Amendments to the Booking Agreement and deviations from these General Booking Conditions shall only be valid if agreed in writing between the Rental Firm or the Booking Agent and the Hirer. If changes result in an increase or decrease in costs, any resulting change in the rental price must be agreed in writing between the parties.
4.6.If the tenant wishes to cancel the reservation after two working days from the date of the of the booking confirmation, Casa-Unlimited can charge the tenant a fee of 100 euros by invoice.
Article 5. Cancellation, modification by Casa-Unlimited
5.1. Casa-Unlimited reserves the right to cancel or modify the booked accommodation for important reasons. Important reasons are defined as circumstances which are of such a nature that Casa-Unlimited cannot reasonably be required to continue with the contract.
Casa-Unlimited will offer the tenant an alternative if and insofar as possible. If the tenant does not agrees the proposed alternative, he must notify Casa-Unlimited of this within two working days of receipt of the days after receiving notice of the change. The part of the rent paid will be refunded to the tenant.
5.2. If the cause of the cancellation or alteration is attributable to the tenant, the resulting damage shall be borne by the tenant. If the cause of the cancellation or modification is attributable to Casa-Unlimited, the resulting damage shall be borne by Casa-Unlimited.
Article 6: Length of stay, stay, arrival and departure
6.1 Check-in is possible between 16:00 and 19:00. Earlier than 16:00h is generally not possible. If you expect to arrive at your destination later, you should inform Casa-Unlimited of this; charges will apply.
6.2 Check-out is before 11:00 on the day of departure, later departure will incur additional costs. Upon departure, the tenant must leave the accommodation in a proper state, i.e. broom clean. Things present in and around the accommodation should be returned to their original place (as on arrival). Crockery should be washed and stored in the designated place. The accommodation provider is entitled to carry out a final inspection. If the accommodation provider finds that several items have not been returned to their original place or if the accommodation has not been left broom clean, he is entitled to charge additional costs to the lessee.
6.3 On the website and in the price list, you can see whether cleaning costs are included for the accommodation in question. If this is not the case, the relevant costs are listed. These are stated together with the rental price on the booking and reservation form. As a rule, these costs are settled on the day of arrival at the key address.
6.4 As a rule, bed and bath linen are included in the rental price.
6.5 Parties and celebrations are prohibited unless written permission from the hirer. Parties and celebrations means any type of gathering where more than 4 external guests are invited. It is also understood to mean any type of gathering where nuisance is caused to local residents.
6.6 Casa-Unlimited cannot be held liable for any nuisance caused by (construction) work in the area.
6.7 Normal use of water, electricity and gas is included in the rental price. It is strictly prohibited to charge electric and/or hybrid vehicles through the electric network of the rented property without the written consent of the lessor, even if specific infrastructure for charging vehicles is available. Casa-Unlimited cannot be held liable for any utility failures.
6.8 Garden and pool maintenance is required, you, the guest, are obliged to grant access to the maintenance people if necessary. Guests are strictly prohibited from operating the installations present themselves.
Article 7. Liability, force majeure
7.1. Casa-Unlimited is not liable for loss, theft, injury or any other damage of whatever nature suffered by the to the tenant. It is the responsibility of the tenant to take out adequate insurance for the above-mentioned situations.
7.2. Except in the case of intent or gross negligence on the part of Casa-Unlimited, Casa-Unlimited is not liable for shortcomings in the execution of the agreement (also by third parties), which are caused by circumstances that could not have been foreseen by Casa-Unlimited.
7.3. Casa-Unlimited is also not liable for shortcomings in the execution of the agreement due to force majeure. Force majeure is understood to mean abnormal and unforeseeable circumstances which are independent of the will of the person invoking it and the consequences of which could not have been avoided.
7.4. The tenant must notify Casa-Unlimited of any deficiencies of the accommodation immediately and in writing.
Article 8. Liability of the tenant(s)
8.1. The tenant is liable for all loss and/or damage during the rental period that is the result of his/her stay during the rental period, if this damage is caused by the acts or omissions of the tenant and/or co-tenants (or other persons which provided access by tenants and/or co-tenants), or by any animal or object/property in their possession.
Article 9. Final provisions
9.1. The number of persons staying in the booked accommodation must not exceed the number for which it had been booked and as stated in the booking confirmation.
9.2. The tenant is not permitted to sublet or otherwise make the accommodation available to third parties.
9.3. All offers made by Casa-Unlimited on the Internet, in brochures, advertisements or other publications are non-binding and may be revoked. Withdrawal will take place within 48 hours after acceptance by Casa-Unlimited. Obvious errors and mistakes in Casa-Unlimited publications are not binding on Casa-Unlimited.
9.4. All offers, agreements and their execution, to which these terms and conditions of rental in whole or in part, shall be governed exclusively by Spanish law.
9.5 The terms and conditions of the booking confirmation received by the tenant shall prevail, even if they are shall prevail, even if they differ from Casa-Unlimited’s general terms and conditions.
